UdeG gets suspended over budget cut for Science Museum

The Supreme Court of Justice of the Nation (SCJN) has granted a suspension in favor of the University of Guadalajara (UdeG), based on the constitutional controversy it has brought over the 140 million pesos budget cut.

The court shall order that things be kept in the state in which they are, Which means that the Jalisco government cannot exercise the money that was intended for the Museum of Environmental Sciences and that has been redirected to the Civil Hospital of the East in Tonala.. This is until the merits of the issue are resolved.

On the other hand, the court refused to return the funds to Al-Aqsa Studies House for the time being according to file 135/2021:

“Its purpose is only to preserve the matter of the trial and to ensure that the respondent authority does not issue any act that impedes, stops, prevents, arranges, re-subscribes, reallocates or reimburses unearned resources, as well as to temporarily secure the legal status and right or interest of the plaintiff,” As stated in the document.

For its part, the state government confirmed, through a statement, that the reallocation of 140 million pesos was made in accordance with its powers.

“It has been confirmed that the reallocation of 140 million pesos was made in accordance with the powers and authorities of the executive branch and that.” These resources have already been provided and committed to the hospital business which is run by the University of Guadalajara itself by the way.Accordingly, they are already a fait accompli and should not be brought back to that determination.”

For the state government, accepting said controversy is not enough, so it will sue it until the full court can hear it and decide its legality.

The background to the differences between the state and the UdeG began on August 6, 2021. The emerging part of the last local legislature required amendments to budget line 41565 for internal transfers granted to non-commercial non-financial quasi-governmental entities for public investment. This resulted in a reallocation of 140 million pesos (MDP) from the item that was intended for the Museum of Environmental Sciences of the University of Guadalajara.
