What are the sanctions for non-compliance with payment of minimum wages?
If you don't make your full minimum hourly wage, the Department of Labor can let employers know two ways.
- Payment Orders: The employer may be ordered to pay back wages, late or non-payment interest, liquidated damages and penalties.
- Criminal Proceedings: Employers who fail to comply with the minimum wage law are subject to criminal proceedings and sanctions. Penalties for violations can add up to 200% of lost wages. They will also have to pay 16% interest on unpaid wages.
