The Immigration Service has announced a temporary waiver of the 60-day medical package for legal permanent residency (green card or green card) applicants.
The move is aimed at helping immigrants affected by the epidemic and obtaining health certificates beyond the required timeframe.
The Office of Citizenship and Immigration Services (USCIS) requires civil practitioners to sign Form I-693 (Medical Examination Report and Vaccine Register) no later than 60 days prior to filing the Immigration Benefit Form. Until September 30, 2022, Form I- 485, including an application for permanent residence registration or adjustment of status, ”the company said in a statement.
“The requirements for immigrants implementing a green card include a set of medical tests,” explains Jose Guerrero, an immigration lawyer trained in Miami (Florida).
“The package, which will be sent with all the documents of the case, contains medical certificates and proof of vaccination. The regulation states that the doctor’s signature should not be withheld for more than 60 days. But now they are exempt until the end of September next year,” he added.
“Many immigrants have delayed selection or reception of the package due to the epidemic, and when they collect and send the documents 60 days after they are signed, they will no longer be rejected. This is definitely good news,” he said.
USCIS said, “This temporary waiver will help applicants affected by the COVID-19 infection and delays in processing related to that infection, which can sometimes lead to delays in completing immigration medical testing.”
The federal agency also said the provisional decision allows documents to be submitted “even if the authorized civil physician signs the documents 60 days in advance.” If so, immigrants seeking a green card should not “repeat the medical examination if Form I-693 is still valid.”
The USCIS said in the panel of immigrants benefiting from the exception, “Days of expulsion of Afghan nationals under Operation Welcome Alice (OAW) to complete medical examination.”
